摘 要 ：本文通过分析《民法典》第1091条新增“其他重大过错”的范围，论述了三方面“其他重大过错”包含的能够获得离婚损害赔偿的情形,并针对不足之处提出了完善建议。本文首先论述了离婚损害赔偿的变迁，作者从两方面对兜底条款进行了评价，指出了其的进步意义和不足之处。其次作者根据我国的社会现实和相关案例，对常见的三种情形研究了离婚损害赔偿中有其他重大过错的情形，包括违反夫妻忠实义务方面如通奸或他人通奸生子，卖淫嫖娼等；剥夺另一方生育权；违反夫妻尊重义务等。最后作者从立法和司法层面提出了完善建议。研究离婚损害赔偿有其他重大过错的情形，将更有助于保障无过错的合法权益，维持公平正义，具有填补损害、精神抚慰、制裁过错方的功能。

Study on other major faults in divorce damage

Abstract:This paper analyzes the scope of the new "other major faults" inarticle 1091 of the Civil Code,discusses the situation of "other major faults" in three aspects, and puts forward some suggestions for perfection. This paper first discusses the change of divorce damage compensation,the author evaluates the bottom clause from two aspects, and points out its progressive significance and shortcomings. Secondly, according to the social reality and related cases of our country,the author studies the other major faults in the compensation for divorce damage, including the violation of husband and wife's duty of loyalty, such as adultery or adultery, prostitution, etc. Deprivation of the other party's right to give birth;violation of the husband and wife's obligation to respect. Finally, the author puts forward some suggestions from the legislative and judicial level.It is helpful to protect the legal rights and interests without fault, maintain fairness and justice, and have the function .
