| 我国现存知识产权问题及解决建议 摘 要 在经济全球化和贸易全球化下，知识产权越来越成为企业之间核心竞争力的重要因素。知识产权是企业竞争和无形财产中的最重要的竞争武器。加强知识产权保护并且提升我国自主创新能力，越来越成为国际竞争的焦点，越发成为我国增强综合国力和提高国际竞争力的必由之路。近年来，我国知识产权现状十分复杂，专利申请的总量达到世界第一，然而申请专利的质量粗制滥造。而且知识产权保护效率低下，保护方面也存在着不少问题。有些企业利用知识产权法律的漏洞形成市场垄断，滥用知识产权形成不正当竞争，制约我国经济持续健康的发展，影响我国在国际市场的竞争地位。在如此复杂的竞争市场中，知识产权问题突出，为提高企业竞争力和经济效益，这些问题是亟待解决的。本文针对我国知识产权现状，剖析出深层次原因，揭示造成知识产权问题的原因，提出如何加强知识产权保护、完善知识产权保护制度、加大知识产权型人才培养力度等举措。 关键词：知识产权；经济学；知识产权法 Abstract In the context of economic globalization and trade globalization,intellectual property has become an increasingly important factor in the core competitiveness of enterprises. Intellectual property is the most important competitiveweapon in enterprise competition and intangible property. Strengthening the protection of intellectual property rights and enhancing China's capacity forindependent innovation have increasingly become the focus of international competition and the only way for China to enhance its comprehensive national strength and international competitiveness. In recent years, China's intellectual property status is very complex,the total number of patent applications reached the world's first, but the quality of patent applications is shoddy. Moreover, the protection of intellectual property is inefficient, and there are also many problems in protection. Some enterprises take advantage of the loopholes of intellectual property laws to form market monopoly,abuse intellectual propertyrights to form unfair competition, restrict the sustainable and healthy development of China's economy, and affect China's competitive position in the international market. In such a complex competitive market, the problem of intellectual property is prominent.In order to improve the competitiveness and economic efficiency of enterprises, these problems need to be solved urgently. Based on the current situation of intellectual property in China,this paper analyzes the underlying causes,reveals the causes of intellectual property problems, and puts forward measures such as how to strengthen intellectual property protection, perfect intellectual property protection system, and strengthen the training of intellectual property talents.
