摘要：随着全球产品质量问题的日渐发酵，缺陷产品召回制度成了各国关注的重点。我国也在此“潮流”中，但由于我国关于缺陷产品召回问题的立法起步较晚，采用的法律位阶较低，涉及的产品种类较少，以致世界大牌尤其是汽车行业等时常把中国市场排除在缺陷产品召回的范围之外。本文针对以上问题，将主要采用文献研究法和比较研究法，将中国和国外关于缺陷产品召回制度的相关现状列出，并进行比较分析，从而在实体方面和程序方面得出恰当的改进方案，实现缺陷产品召回制度的本土化完善。

Abstract: With the global product quality problem fermenting day by day,defective product recall system has become the focus of attention of all countries. China is also in this "trend".However, due to the late start of China's legislation on defective product recall,the adoption of low legal rank, involving a small number of products,so that the world's big brands, especially the automobile industry , often exclude the Chinese market from the scope of defective product recall. In view of the above problems,this paper will mainly adopt the literature research method and comparative research methodto list the relevant status quo of defective product recall system in China and abroad, and carry out comparative analysis, so as to come up with the appropriate improvement plan in the entity and procedure aspects, and realize the localization and perfection of defective product recall system.
