摘　　要

人情问题一直是法治建设中比较常见的问题，有时人情关系甚至会影响到法律的客观实施。本文通过对东方快车谋杀案中的法律与人性进行分析，探究了人性与法理的并存之法。
在东方快车上发生了一起谋杀案，死者是一个名叫雷切特的商人，他被发现死在自己的包厢里，身上多处刺伤。在波罗的一番调查之后才发现，凶手竟然有十二个人。这十二个人合谋杀死了一个逃脱法律制裁的穷凶极恶之人，他们都是为复仇而来。当法律与人性产生矛盾，到底该如何抉择呢？此篇通过分析案件动机以及过程，对比波洛前后态度的转变，研究《东方快车谋杀案》中法律与人性的矛盾。许多读者都是分析这一谋杀案的正义性，而本篇则是在此基础上，更加深入探讨案件的公正性以及造成这一悲剧的原因。本篇主要运用文本分析法，通过阅读小说原文以及对国内外学者的文章进行分析。其研究结果表明：1）同态复仇不值得提倡；2）没有永远的秘密；3）百因必有果；4）事物具有两面性；5）法理与人情可以兼顾。本文通过研究人情与法理之间的关系，不仅让读者更加理解小说的核心思想，也帮助我们更好地了解人性的多样性。

ABSTRACT

Human nature has always been a widespread problem in the construction of the rule of law.Sometimes humanity may even affect the impartial implementation of laws.This paper analyzes the law and humanity in the Murder on the Orient Express, and explores the coexistence of humanity and jurisprudence.
There was a murder on the Orient Express.The deceased was a businessman named Re Chet,who was killed in his box with many stabbing on his body. After Poirot’s investigation, it finds that there were 12 killers.The twelve men murdered an atrocious man who escaped justice.When the law conflicts with human nature, how to choose?This article analyzes the motives of the case and the process,compares the change of Poirot’s attitude, and studies the contradiction between law and humanity in the Murder on the Orient Express. Countless readers have analyzed the justice of the murder,and this article explores the justice of the case and the cause of the tragedy in greater depth. This paper uses the text analysis method,by reading the original novel and the articles of domestic and foreign scholars,then results show that: 1) homomorphic revenge is not worth advocating; 2) there are no permanent secrets; 3) there must be consequences for the reasons; 4) things have two sides; 5) jurisprudence and humanity can be taken into account. By reading the relationship between human feelings and legal principles,this paper not only makes readers understand the core idea of the noveldeeply, but also enables us to understand the diversity of human nature.
