| 城市生活垃圾分类回收法律问题研究 摘要 随着我国经济的快速发展，城市化速度也不断加快，居民生活水平也有较大提高，但城市生活垃圾的总量也在增加，许多城市甚至出现了垃圾围城的现象，严重影响城市的发展。城市生活垃圾的管理问题亟待解决。本文从法律角度出发来研究，进而对城市生活垃圾分类回收进行正确而有效的法律规制。我国城市生活垃圾分类回收存在的主要法律问题有缺乏专门性立法；现有法律法规操作性差，配套体系不健全；法律责任规定不明确；相关法律制度不完善。针对这类问题，我们应立足于我国现有的立法现状，同时借鉴国外先进的城市生活垃圾分类回收的法律制度，从而提出对应的解决方法。通过上述分析应制定专门性法律、完善法律法规体系、明确各主体法律责任、完善相应的配套法律制度。 关键词：城市生活垃圾；分类回收；法律制度；完善建议 ABSTRACT With the rapid development of our country's economy,the speed of urbanization has also been accelerating, and the living standards of residents have also been greatly improved, but the total amount of urban domestic waste is also increasing, and many cities have even seen the phenomenon of garbage siege, which has seriously affected the development of the city. The management problem of municipal solid waste needs to be solved urgently.This article studies from a legal point of view,and then carries out correct and effective legal regulations on the classification and recycling of municipal solid waste. The main legal problems existing in the classification and recycling of urban domestic waste in my country are the lack of specialized legislation;the existing laws and regulations are poorly operable and the supporting system is not sound; the legal liability regulations are not clear; and the relevant legal systems are not perfect. In response to this type of problem,we should base ourselves on our country’s current legislative status, and at the same time learn from the advanced foreign legal systems for the classification and recycling of municipal solid waste, so as to propose corresponding solutions. Through the above analysis, it is necessary to formulate special laws,improve the legal system,clarify the legal responsibilities of each subject, and improve the corresponding supporting legal systems.
