用人单位规章制度司法审查研究


摘 要
 
用人单位规章制度的内容一直以来错综复杂,且劳动规章的内容与劳动法规、劳动协议、集体合同等紧密联系,本文从用人单位规章制度司法审查的角度出发,通过对域外几个国家司法审查制度进行考察分析,从中得到可以借鉴的启示,然后从我国用人单位规章制度司法审查的实际状况和审查过程中存在的问题出发,深入探讨用人单位规章制度司法审查的法律依据、审查理念、程序规范以及基本原则和审查标准,针对用人单位规章制度司法审查的问题,提出相应的完善建议。对用人单位规章制度的司法审查主要是平衡用人单位与劳动者之间的利益冲突,在不破坏用人单位管理和经营自主权的基础上,加大保障劳动者就业权与生存权的力度。只有这样才能有效的维护劳资关系的稳固,从而推动社会经济和谐稳定发展。
 
本文分为五个部分对用人单位规章制度的司法审查进行研究,第一部分是本文的选题背景、理论意义、现实意义、研究方法、创新点和研究框架进行介绍。第二部分是用人单位规章制度司法审查的概述,该部分围绕三个方面展开分析,第一是用人单位规章制度司法审查的定义,第二是用人单位规章制度司法审查的价值旨向,第三是用人单位规章制度的机理。第三部分是域外用人单位规章制度司法审查的分析与启示。第四部分是用人单位规章制度司法审查的现存问题,总结为司法审查中司法机关的司法权介入缺少原则性限制、司法审查法律依据不够清晰、司法审查受传统理念影响、司法审查缺少统一衡量标准、司法审查缺少程序规范等问题。第五部分是本文研究的重点,进一步就如何解决当前司法审查中存在的问题提出相应的完善建议,解决司法审查面临的问题是一项系统的工程,不仅需要确立用人单位规章制度司法审查的基本原则、完善司法审查的法律依据、树立正确的司法审查理念,还需要确立司法审查的衡量标准和明确正当的司法审查程序。

Abstract
 
The content of the employer’s rules and regulations has always been intricate,and the content of the labor regulations is closely related to labor laws, labor agreements, collective contracts, etc. This article starts from the perspective of judicial review of the employer’srules and regulations and conducts judicial review of several foreign countries. Through investigation and analysis, we can get some enlightenment for reference.Then, starting from the actual situation of the judicial review of the employer’s rules and regulations and the problems existing in the review process, we will deeply explore the legal basis, review concepts,procedural norms and basics of the judicial review of the employer’s rules and regulations. Principles and review standards,and put forward corresponding improvement suggestions for the judicial review of the employer’s rules and regulations. Judicial review of the rules and regulations of employers is mainlyto balance the conflicts of interest between employers and workers. On the basis of not undermining the management and operation autonomy of employers,it is necessary to strengthen the protection of workers' right to employment and survival. Only in this way can we effectively maintain the stability of labor-management relations and promote the harmonious and stable development of social economy.
 
This article is divided into five parts to study the judicial review of the employer's rules and regulations. The first part is an introduction to the topic background, theoretical significance,practical significance, research methods, innovation points and research framework of this article. The second part is an overview of the judicial review of the rules and regulations of the employer. This part analyzes in three aspects.The first is the definition of the judicial review of the rules and regulations of the employer.The second is the value and purpose of the judicialreview of the rules and regulations of the employer. It is the mechanism of the employer's rules and regulations.The third part is the analysis and enlightenment of judicial review of the rules and regulations of foreign employers. The fourth part is about the existing problems of the judicial review of the rules and regulations of the employer. It is summarized as the lack of principled restrictions on the judicial intervention of the judicial authority in the judicial review,the lack of clear legal basis for the judicial review,the influence of the traditional concept of the judicial review, and the lack of a unified measurement standard for the judicial review. , Judicial review lacks procedural norms and other issues.The fifth part is the focus of this article.It further proposes corresponding suggestions on how to solve the current problems in judicial review. Solving the problems faced by judicial review is a systematic project,which not only needs to establish the basic rules of judicial review of the employer’s rules and regulations. Principles, to improve the legal basis of judicial review,and to establish a correct concept of judicial review,it is also necessary to establish judicial review measurement standards and clear and legitimate judicial review procedures.
