摘 要

家庭的和谐美满是每个人共同的心愿，而家庭冷暴力的存在会给每个家庭成员的心理和身体带来无法磨灭的伤害。当今社会法律制度逐渐健全、人们的知识文化水平和自我保护意识都有增强，家庭矛盾的解决方式由传统的武力解决转变为更隐秘的“冷暴力”的形式，且这种形式可能会成为未来的主导形式，它影响到的不仅是受害者，更会对其他家庭成员产生影响，例如可能会改变孩子的成长轨迹，造成家庭破裂，更会以个体的形式影响到社会这个整体，影响到社会偏离正常轨道。但它存在着认定困难、证据获取较难、法律制度不够完善等缺点，希望能够通过对于家庭冷暴力的概念以及相关案例的解读，提出一些合适的宣传政策，并针对目前存在的一些问题，提出合理的预防和救助措施，让大众树立对它正确的认知，完善相关立法，减少这种现象的存在并为家庭冷暴力的受害者提供一个好的救助渠道。

论文分为四个部分，首先介绍论文的选题背景和意义、文献综述以及研究方法；其次，介绍“家庭冷暴力”的概念、特征、成因和危害以及案例分析；再次，分析家庭冷暴力法律制度的缺失及表现，最后提出家庭冷暴力的防控和制度完善措施。

Abstract

Legal system gradually perfect today's society,people's cultural knowledge level and the ego to protect consciousness has enhanced,family conflicts solution is solvedby the traditional force into a more secretive "cold violence" form, this form may become the dominant form of the future, it is not only affected by the victim, to family member's psychological and spiritual caused irreparable damage, cause the family breakdown, more will be passed on the family to society, affect social harmony and stability. But it there are identified difficulties, evidence acquisition is more difficult, imperfect legal system,such as faults, this paper hope through to the family of cold violence and concepts related to the case study, puts forward some appropriate promotion policy, at the moment and some problems,and puts forward reasonable prevention and relief measures,let the public to set up correct cognition to it, to perfect relevant legislation, reduce the existence of this phenomenon and for the victims of the family of cold violence provided a good relief channels.

The paper is divided into four parts.Firstly, the background and significance of the topic selection, literature review and research methods are introduced. Secondly, it introduces the concept, characteristics,causes and harm of "cold domestic violence" as well as case analysis. Thirdly, it analyzes the lack and performance of the legal system ofdomestic cold violence, and finally puts forward the prevention and control and system improvement measures of domestic cold violence.
