| 浅析刑事侦查阶段电子数据取证中的个人隐私保护 摘要 基于数据大爆炸的时代背景，智能设备中的电子数据已经普遍成为各国的取证对象。然而，智能设备中的电子数据包含大量涉及隐私的信息，在进行侦查时可能会对隐私权产生侵害。本文主要探索电子数据取证中关于公民隐私权可能存在的问题，以及对如何在搜取合法有效电子数据和保护公民隐私权这两种利益之间中寻求平衡的问题提出一些建议。 关键词：刑事侦查；电子数据取证；隐私权保护；问题及建议 Personal privacy protection in electronic data forensics in criminal investigation stage Abstract Based on the background of big data explosion,the electronic data in intelligent devices has become the object of forensics in many countries. However, the electronic data in intelligent devices contain a large amount of information involving privacy, which may infringe the privacy right when conducting investigation. This paper mainly explores the possible problems of citizens' right to privacy in electronic data forensics, and puts forward some suggestions on how to seek a balance between the interests of obtaining legal and effective electronic data and protecting citizens' right to privacy.
