| 浅析我国非法证据排除规则 摘要：本文采用文献研究法及比较法等方式，从非法证据排除规则的概念入手，阐述了对其的理解，分析了非法证据排除规则的确立及立法目的，非法证据的种类及表现形式，还通过观察国外非法证据排除规则的立法以便为我国提供一些启示，还分析了当下非法证据排除规则的现状及现存的不足，对此提出了相应的完善建议，期望通过本文的书写，使自己加强对该规定的理解学习，同时也希望能为完善我国的非法证据排除规则尽一份微薄之力。 关键词：非法证据 规则 刑事诉讼 实物证据 言词证据 Abstract: This paper uses the methods of literature research and comparison, starting from the concept of exclusionary rule of illegal evidence,expounds its understanding, analyzes the establishment and legislative purpose of exclusionary rule of illegal evidence,the types and manifestations of illegal evidence,and provides some enlightenment for our country by observing the legislation of exclusionary rule of illegal evidence abroad, and also analyzes the current illegal evidence According to the current situation and the existing shortcomings of the exclusionary rule, this paper puts forward some suggestions to improve it, hoping that through the writing of this paper, I can strengthen my understanding of the rule, and at the same time, I hope to make a modest effort to improve the exclusionary rule of illegal evidence in China.
