| 论我国校园伤害事故中学校的责任认定 摘要：学校在校园伤害事故中扮演着重要角色，解决校园伤害事故的中心就在于如何确定学校的责任范围和过错程度。侵权主体多样性、侵权方式复杂性使得相关事故并不能够通过原有的单一规范得到有效解决处理。本文首先通过明确校园伤害事故的主体、空间、边界范围以及性质，明确校园伤害事故中以一般过错责任为原则，过错推定责任为补充，同时限制使用公平责任的归责原则。进而从侵权损害事实、违反法定义务、校方行为与损害事实之间的因果关系结合校方的主观过错四个方面进行校园伤害事故的责任认定，并对我国校园伤害事故提出相关完善建议。 关键词：校园伤害事故；归责原则；责任认定；完善建议 On the responsibility of the school in China's campus injury accident Abstract: The school plays an important role in the campus injury accident, and the center of the campus injury accident lies in how to determine the scope of responsibility and the degree of fault of the school. The diversity of torts and the complexity of torts make the relevant accidents not be solved effectively by the original single standard. This paper through the clear campus damage accident of main body, space, boundaries, and the nature, clear campus damage accident in General Feature Generalization, presumption of fault liability as supplement, at the same time limit the use of fair liability imputation principle. From tort fact which, in violation of the statutory obligations, the school fact cause-and-effect relationship between behavior and damage with the four aspects of subjective fault of the school campus injury accident responsibility identification, and by reference to other relevant state system, aiming at campus injury accident put forward proposals for perfecting.
