| 论民间文学艺术的知识产权保护 摘要：在拥有悠久历史的中华名族和博大精深的中华文化背景下，民间文学艺术丰富性是显而易见的，但由于其缺乏知识产权保护，使民间文学艺术被歪曲、损害、滥用，甚至面临失传的巨大危险。所以对民间文学艺术进行保护成为了日益凸出的世界性问题，运用法律手段保护历史文化遗产也越来越引起国家和社会的存眷。鉴于此，从我国立法现状出发，结合实际情况，找出要解决的问题，再借鉴国外对于民间文学艺术知识产权保护的立法经验，为完善我国的立法保护机制提出建议。 Under the backdrop of a long history of Chinese ethnic groups and a profound Chinese culture, the richness of folk literature and art is obvious. However, due to its lack of intellectual property protection, folk literature and art have been distorted, damaged, abused, and even faced great danger of loss.Therefore, the protection of folk literature and art has become a prominent worldwide issue. The use of legal means to protect historical and cultural heritage has also increasingly attracted the attention of the state and society.In view of this, starting from the status quo of China’s legislation, combining the actual situation, we must find out the problems to be solved, and then draw lessons from the legislative experience of foreign countries in the protection of intellectual property rights in folk literature and arts, and put forward suggestions for improving our country’s legislative protection mechanism 关键词：民间文学艺术、知识产权保护、法律构建  |
