电子竞技直播著作权问题研究 摘要:随着电子竞技直播行业火速发展,带来了巨大发展利益,也引起了规范和保护的需要。因此,我们应当先明确电子竞技游戏直播画面的可版权性和归属,首先,电子竞技和传统的体育赛事一样,是人与人之间的竞技,并不是文学或者科学领域的内容,不能构成作品。第二,电竞直播者所添加的解说,镜头转换等都不具有独创性,不能使电竞直播画面构成作品,却能够构成归属于直播者的邻接权。第三,非电竞类游戏直播画面是游戏整体直播画面的一部分,具有独创性,属于类电作品,应当归属于游戏开发商。最后,电子竞技赛事的直播者,对于电子竞技赛事的操作构成表演,享有表演者权。因此,分析上述各类版权人是否能对游戏画面进行规制。未经许可的游戏直播是否侵犯开发商享有的权利,能否构成合理使用。以此来改善电子竞技赛事直播版权机制,采用完善立法,规范法律适用,制定行业规则以及构建版权许可平台的方式来应对当下电子竞技直播侵权案件,来促进电子竞技直播行业的规范运行。 关键词:电子竞技直播 独创性 可版权性 合理使用 Study on copyright issues of live broadcast of E-sports events Regulations Abstract: In recent years,rapid development of E-sports live broadcasting industry.It has brought huge development benefits,at the same time,it also causes the need of regulations and protection.Therefore,we should make it clear first copyright and ownership of live video of electronic competitive games. First of all, E-sports is the same as traditional sports events,it is competition between people and not about literature or science,can not constitute a work.The second,commentary camera conversion ,picture presentation ,etc,added by E-sports live broadcast.we can not make the live video of E-sports a work.But it can constitute the right of adjacency belonging to the broadcaster—fixation on video.Thirdly,the live video of non electronic games is actually a part ofthe overall live video of the game ,bear the imprint of originality.It belongs to electronic works,belonging to game developers.At last,the operation of E-sports can constitute a performance,enjoy the right of adjacency—rights of performer.On the basis,analyze whether the above copyright owners can regulate the game screen.Whether the unauthorized live game violates the copyrightenjoyed by game developer,whether it constitute fair use.In order to improve the copyright mechanism of E-sports live broadcast.Through improving legislation ,regulating the application of law,making industry rules and building copyright licensing platform to deal with the current E-sports live infringement cases.In order to promote the standard operation and vigorous development of E-sports live broadcasting industry.
