| 论网络作品的著作权保护 摘 要 从2019年开始，5G技术在我国开始大规模商用，在网络信息化的背景下，互联网也开始飞速发展。在网络时代，人民为追求更好的物质文化追求，也越来越多地在互联网上发表作品。网络作品不同于传统时代以书本、光盘等为载体传播的作品，网络作品同样是现代文化产业的重要组成部分。在这一背景下，侵犯网络作品著作权的现象却时有发生，然而，由于法的滞后性，我国现有的著作权法不能很好地解决网络作品的著作权侵权问题。因此在当前情形下，对网络作品的著作权保护问题进行探讨具有非常重要的意义，能够预防网络作品抄袭，推动网络创作秩序的健康发展。同时，在著作权保护的过程中，仅仅依靠法的制约是远远不够的，广大网络用户的知识产权保护意识淡薄、对网络平台的监管不严以及权利人的维权难度大、成本高是我国现行著作权法面临的现实问题。再此基础上，本文将从微信公众号和微博上的网络作品的著作权保护、网络视频的著作权保护、网络直播的著作权保护、互联网上的民间艺术产品的著作权保护以及上述问题的解决对策等方面入手，探讨网络作品的著作权保护的良性发现途径，为我国互联网上的文化创作提供更好的法律环境。 关键词：网络作品；著作权；法律保护 ABSTRACT Since 2019, 5G technology has been commercialized on a large scale in China.In the context of network informatization, the Internet has also begun to develop rapidly.In the Internet era, more and more works are published on the Internet in order to pursue better material and cultural pursuits.Network works are different from the traditional era of books,CDs and other works as the carrier of dissemination, network works are also an important part of the modern cultural industry.In this context, the phenomenon of infringement of network works copyright has occurred from time to time. However, due to the lag of law,the existing copyright law in China can not solve the problem of copyright infringement of network works.Therefore, under the current circumstances,it is of great significance to discuss thecopyright protection of network works, which can prevent the plagiarism of network works and promote the healthy development of the order of network creation.At the same time, in the process of copyright protection,it is far from enough to rely only on legal restrictions. The current copyright law in China is faced with practical problems such as weakawareness of intellectual property protection among network users,lax supervision of network platforms, difficulty and high cost of right holders' rights protection.Again this basis, this article will from WeChat public number and the protection of copyright in works of micro blog network, network video copyright protection,live online copyright protection and copyright protection and the folk art of products on the Internet into the countermeasures to resolve the problem, the author discusses the protection of copyright in works of network, the benign found ways to provide cultural creation of the Internet in our country a better legal environment.
