| 论家庭暴力法律预防机制
摘 要
据全国妇联调查结果得知，在我国的2.7亿个家庭中，大约有30%的家庭存在家庭暴力。“我被家庭暴力了，过去的时间我活在噩梦里，我必须要说出来！”。2019年11月25日国际反家庭暴力日，微博热搜对家庭暴力的关注度异常火爆。其原因是一名宇姓博主被男友多次家暴，她非常勇敢的面对镜头拍下视频，并说出了这个秘密。这条微博达到全站日榜第一名，点击量超过1.8亿，引起了网民们的广泛关注。根据全国妇女联合会做出的数据统计显示，在中国2.8亿个家庭中，存在家庭暴力的约占25%。
我国《反家庭暴力法》于2015年12月7日通过，此后越来越多的人们了解到了什么是家庭暴力。现如今，家庭暴力涵盖了更多的含义，不仅只针对于女性，还涵盖了所有的家庭成员以及同居关系。但因现实情况的多变，依然存在很多家暴问题难以维权，所以这就需要在家暴行为越来越多的情况下，及时将其扼杀掉，防止更多的人受到家暴的侵害。预防家庭暴力的作用是不可忽视的，我国现行法律在预防方面还是存在欠缺，需完善改进。进一步消除社会刻板印象与偏见，主动预防家庭暴力是需要我们去积极行动的。
论文全文分五个部分对我国家庭暴力预防机制的法律问题进行论述。
第一部分为导言，就选题背景及意义、国内外文献综述、论文主要内容以及研究方法等进行阐述；
第二部分是我国对家庭暴力内涵的诠释，对家庭暴力的概念及分类进行阐述，并对家庭暴力的危害进行了浅析；
第三部分梳理了我国现行法律预防家庭暴力的法律现状，并剖析了现有预防机制的中的不足；
第四部分对英国、美国关于预防家庭暴力的立法实践做了简单介绍，及对我国法律制度的启示；
第五部分针对我国家庭暴力预防机制法律制度提出相应的完善建议；

Abstract
"I've been abused, I've been living a nightmare for the past time, and I have to say it!".On November 25, 2019,the day of the international day against domestic violence, microblog searches were very popular.The reason is that a blogger surnamed you was repeatedly abused by her boyfriend.She bravely took a video and told the secret.The post reached the top of the website's daily list, with more than 180 million hits.According to statistics from the all-china women's federation,about 25 percent of the 280 million households in China have domestic violence.China’s anti-domestic violence law was also passed on December 7, 2015.More and more people are aware of the concept of domestic violence.Nowadays, domestic violence covers more meaning, not only for women,also covers all the family members as well as the relationship,but because of the reality of changing,domestic violence still faces a difficult problem to human rights, and this would require the violence in the home to a growing number of cases, in a timely manner to contain in the cradle.The effect of prevention on anti-domestic violence can not be ignored.To further eliminate social stereotypes and prejudice,active prevention of domestic violence is required of us to take active action.
The paper is divided into five parts to discuss the legalissues of domestic violence prevention mechanism in China.The first part is the introduction, which expounds the background and significance of the topic,the literature review at home and abroad, the main contents of the paper and the research methods.The second part is China's interpretation of the connotation of domestic violence,the concept and classification of domestic violence, and the harm of domestic violence is analyzed.The third part summarizes the current legal situation of domestic violence prevention in China and analyzes the shortcomings of the existing prevention mechanism.The fourth part makes a brief introduction to the legislation practice ofdomestic violence prevention in the United Kingdom and the United States.The fifth part puts forward some Suggestions to improve the domestic violence prevention mechanism in China.
