| 马锡五审判模式研究 摘要：马锡五审判模式是陕甘宁地区在抗日战争时期实行的便利人民群众的法庭审判制度，以坚持一切从实际出发、走人民路线以及实行灵活便民的审判方式为特点，这种审判方式融合了审判和调解，在坚持依法审判原则的同时，又便利于群众参加诉讼，在一定程度上维护了人民群众的根本利益。该审判模式蕴含“司法公正、司法为民、司法民主”的法治价值观不仅契合现代司法的基本理念又符合中国国情。马锡五审判模式是我国司法历史上的宝贵经验，不仅稳定了当时中国的社会秩序，直到现在还在司法实践中发挥着重要作用，显现出强大的生命力。 关键词：马锡五审判模式；调解；司法公正；司法为民；法治理念 Abstract: The trial mode of Ma Xiwu is a court trial system in Shanxi-Gansu-Ningxia during the Anti-Japanese War.It is characterized by adhering to all practical principles,taking the people's line and implementing flexible and convenient trial methods.This kind of trial method combines trial and mediation,while adhering to the principle of trial according to law, it is convenient for the masses to participate in litigation and to a certain extent safeguard the fundamental interests of the masses.The judicial model contains the values of "judicial justice,justice for the people, judicial democracy ",which is not only in line with the basic concept of modern justice, but also in line with China's national conditions.
