| 当前中国狱政制度及漏洞浅析—以电影《肖申克的救赎》为引子 摘 要 本文以电影《肖申克的救赎》为引子，围绕监狱体管理制度，对当前中国狱政制度及漏洞进行浅析。虽然这是基于一部虚构小说创作，但仍有其真实性的存在，其实《肖申克的救赎》就是我们整个社会的缩影，这个监狱就是一个比喻，就像你生活中最常见的那些对你造成负担束缚等等压力，让你无法摆脱的事物就好比一份让你很痛苦的工作，或者是一段让你很痛苦的感情，或者是过着看不到未来找不到方向的无趣的生活。所以可以从电影中反映的问题，进而思考美国司法制度中出现的漏洞，对中西方监狱制度进行对比，分析中美法制的区别。反观我国出现的漏洞有哪些，其后结合狱政管理和司法实践的实施中的具体案例与服刑人员的亲身经历展开分析。最后得出中国监狱制度取得了什么成效？辩证的看待我国监狱制度的实施效果。就我国当下监狱中有出现什么样的管理乱象，对当前我国监狱行政管理体制运行现状的认识，最后得出监狱管理体制存在哪些问题，以及及相关漏洞的解决方式。依法治国首要的是依法治人。认认真真使人们认识到“刑不上大夫，礼不下庶人”、“父尊子贵”、“一人得道，鸡犬升天”等等腐朽陈旧的观念，应该彻底清除了，代之以“法律面前人人平等”，从而增强法制观念、法律意识，为依法治国扫除思想意识上的障碍。 关键词：监狱法；监狱执行；司法腐败； Abstract In this paper, the film "Shawshank Redemption" as the introduction,around the prison management system, the current Chinese prison system and loopholes were analyzed. Although it is based on a fictional novels,but still had the existence of its authenticity, in fact, the shawshank redemption is amicrocosm of our society as a whole,the prison is a metaphor, as one of the most common in your life who burden, and so on pressure for you, let you can't get rid of things like a job make you very pain, or is a make you very painful feelings, or live to see the future can not find the direction of the boring life. Therefore, the problems reflected in the film can be used to think about the loopholes in the American judicial system,compare the prison systems of China and the West, and analyze the differences between Chinese and American legal systems. Then it analyzes the specific cases in the implementation of prison administration and judicial practice and the personal experience of the prisoners. Finally, what effect has China's prison system achieved?Dialectical view of our country's prison system implementation effect.Based on what kind of management disorder there is in China's current prison, the understanding of the current situation of China's prison administrative management system, the final conclusion is what problems exist in theprison management system, as well as the solutions to the relevant loopholes. The rule of law is the first and foremost rule of people according to law.Would make people realize the "punishment doesn't go to the doctor,no less than the common people", "your father and son", "one word,the top" and so on the idea of decay, should be thoroughly cleared,instead of "everyone is equal before the law", so as to enhance legal concept, legal consciousness, to the rule of law sweep obstacle on ideology.
