| 福建省H市林业生态环境犯罪实证研究 摘 要 早在上世纪六七十年代，日本、德国等发达国家已经认识到经济发展给生态环境带来的巨大破坏，纷纷加强了对生态环境的刑事立法保护，而我国因为发展起步比较晚，从九十年代才开始慢慢意识到生态环境的重要性，时至今日，生态文明建设已被宪法上升到国家利益的层面，正如习总书记所说“绿水青山就是金山银山”，足以看出我国对生态环境保护的重视，但是现如今生态刑事保护显然已经不适应当前我国对生态环境保护的重视程度，在立法和司法上存在诸多不足之处。众所周知，林业资源是生态环境资源最重要的一环，而H市是福建的“国家公园”试点，其环境优美，地处三省交界处，林业资源丰富，但客观上也存在破坏林业资源犯罪案件频发的现象，故本文通过多种调研方法查找、分析H市破坏林业资源犯罪案件多发的成因和存在困境，探究困境产生的深层次原因，并据此提出对策和建议。 关键词：破坏林业资源犯罪；刑事；困境；原因分析；建议 Empirical Study on Forestry Eco-environmental Crime in H City of Fujian Province Abstract:As early as the 1960s and 70s of the last century,developed countries such as Japan and Germany have recognized the enormous damage caused by economic development to the ecological environment, and have strengthened the criminal legislative protection of the ecological environment. It only began to realize the importance of the ecological environment in the 1950s.Today, the construction of ecological civilization has been elevated to the level of national interest by the Constitution. As General Secretary Xi said,"green water and green mountains are Jinshan and Yinshan",it is enough to see China attaches great importance to ecological environmental protection, but nowadays ecological criminal protection is obviously not suitable for the current degree of importance attached to ecological environmental protection in China, and there are many deficiencies in legislation and justice. As we all know, forestry resources are the most important part of eco-environmental resources, and city H is a pilot project of “national parks” in Fujian. Its environment is beautiful.It is located at the junction of the three provinces and has rich forestry resources.Therefore, this article finds and analyzes the causes of the frequent occurrence of H-destroying forestry resources crime cases and the existence of dilemmas through a variety of investigation methods,explores the deep-seated causes of dilemmas, and proposes countermeasures and suggestions based on the causes.
