| 移动支付若干法律问题研究 摘 要 移动支付作为一种新型的支付方式，是伴随着经济和互联网的发展而逐步发展起来的。不可否认的是，移动支付以其自身的及时、方便、快捷等特性赢得了越来越多人的青睐，但在其快速发展的同时也暴露了许多弊端。本论文分为五个部分对移动支付的法律问题进行研究，第一部分从移动支付的现状及存在的问题出发，第二部分是简述存在这些问题的原因，第三部分是关于我国移动支付的立法现状，第四部分是域外的移动支付制度现状，进而引出第五部分对于完善我国移动支付法律制度的建议。 关键词 移动支付；问题；现状；原因；域外；建议 Research on Some Legal Issues of Mobile Payment Abstract As a new payment method, mobile payment has been gradually developed with the development of economy and internet. There is no denying the fact that mobile payment has won more and more people’s favor for its own characteristics of timeliness, convenience and rapidity, and exposed many drawbacks at the same time of its rapid development. This paper is divided into five parts to study the legal issues of mobile payment, the first part starts form the current situation and existing problems of mobile payment, the second part is a brief description of the reasons for these problems, the third part is about China’s current legislation on mobile payment, the fourth part is the status quo of extraterritorial payment system, and then leads to the fifth part of the legal system of mobile payment in China to improve the recommendations.
