摘 要：当今时代,信息技术迅猛发展,文化产业发展势头迅猛。越来越多人开始从事摄影创作，并涌现出了大量的优秀摄影作品。于此同时,各种针对摄影作品著作权的侵犯相伴而来。图片侵权盗版现象也呈爆炸式增长,并且有关摄影作品保护的法律法规并不完善，有关摄影侵权诉讼案件也逐年上升。在解决摄影作品的侵权问题上,首先要明确摄影作品的概念，对摄影作品进行界定。摄影作品不仅具有法律意义上的作品的特征，还具有自己独有的特征。面对摄影作品频繁被侵权的现状，我们要从根本上完善相关立法,严格保护具备独创性的摄影作品;通过技术手段保护摄影作品;健全著作权集体管理制度。

Abstract：Nowadays, information technology is developingrapidly, and the cultural industry is developing rapidly. More and more people are engaged in photography creation,and a large number of excellent photographic works have emerged. At the same time,all kinds of infringements on the copyright of photographic works have accompanied them. The phenomenon of photo infringement and piracy has also exploded,and the laws and regulations related to the protection of photographic works are not perfect, and the lawsuits of photography infringement are increasing year by year. In solving the problem of infringement of photographic works,we must first clarify the concept of photographic works and define the photographic works. Photography works not only have the characteristics of works inthe legal sense, but also have their own unique characteristics. In the face of the frequent infringement of photographic works,we must fundamentally improve relevant legislation,strictly protect original photographic works; protect photographic works through technical means; and improve the copyright collective management system..
