互联网新型不正当竞争之探析

摘 要


随着互联网的快速发展,人们使用互联网的频率越来越高,而各互联网企业为了抢占市场、争夺用户,不断进行技术创新。新技术的出现促进了互联网经济发展,给人们带来了更多的便利,然而,与此同时,各种互联网新型竞争也开始接连涌现。在互联网时代,互联网各大企业将“流量为王”作为自身发展的主旨。由互联网广告屏蔽行为引起的竞争纠纷尤为引人注目。本文通过对互联网广告屏蔽案件的对比与分析,归纳总结出现实中法官对于此类案件的审判逻辑与认定标准,进而对于现行规制存在的问题进行分析;再结合美国与德国的规制,对互联网广告屏蔽纠纷的解决提供建议,以期完善对互联网广告屏蔽行为的规制。

Abstract

Internet plays an indispensable role in our daily life and impacts us on almost every field.Internet companies continue to make technological innovations in order to seize the market and compete for users. The emergence of new technologies has promoted the developmentof the Internet economy and brought more convenience to people. However, at the same time,various new Internet competitions have begun to emerge one after another. In the Internet era where "traffic is king",competition disputes caused by Internet advertising blocking behaviors are particularly noticeable. Based on the comparison and analysis of Internet advertising blocking cases,this article summarizes the judge’s judgment logic and determination standards for such cases in reality,and then analyzes the problems existing in the current regulations, and combines the regulations of the United States and Germany to block Internet advertising, in order to provide suggestions for the resolution of disputes to improve the regulation of Internet advertising blocking behavior.
