摘 要

夫妻财产制既可以保护婚姻当事人的财产权利，也可以解决夫妻财产纠纷，促进社会的和谐稳定发展。随着我国社会经济的迅速发展,夫妻财产纠纷也开始增多，同时也出现了非常复杂的新情况。为了适应这种社会变化，我国夫妻财产制处在不断完善的过程中，但是我国夫妻财产制的规定仍然无法满足现状，基于此，本文对我国夫妻财产制现状进行分析，进而提出了一些改进措施与建议。本文第一部分对夫妻财产制进行概述，对夫妻财产制的概念和特点进行简单的介绍；第二部分研究了我国夫妻财产制的立法、司法认定现状及民法典对夫妻财产法的完善；第三部分阐述了我国夫妻共同债务的司法认定的现状；第四部分提出完善夫妻财产制与共同债务认定的建议。本文以《民法典》为基础，研究夫妻共同财产制度、约定财产制度及其他特殊制度的规定，提出完善夫妻财产制的建议。

Abstract

The marital property system can not only protect the property rights of marriage parties,but also solve the marital property disputes and promote the harmonious and stable development of society. With the rapid development of China's social economy,the disputes between husband and wife's property havealso started to increase, and at the same time, there have been very complicated new situations. In order to adapt to this social change,China's marital property system is in the process of continuous improvement, but the provisions of China's marital property system still cannot meet the current situation. Based on this, this paper analyzes the current situation of China's marital property system, and then puts forward some improvement measures and suggestions. The first part of this paper summarizes the marital property system and briefly introduces the concept and characteristics of the marital property system. The second part studies the current situation of legislation and judicial cognizance ofmarital property system in China and the perfection of civil code to marital property law. The third part expounds the present situation of judicial determination of joint debt of husband and wife in China;The fourth part puts forward some suggestions to improve the marital property system and the determination of joint debts. Based on the Civil Code, this paper studies the provisions of the maritalproperty system, the agreed property system and other special systems,and puts forward some suggestions to improve the marital property system.
