论商标共存协议的法律效力

论商标共存协议的法律效力

摘要:商标共存协议是“由双方或多方就近似商标能够避免混淆可能性而共存所达成的协议,并允许当事人间为商标和平共存设定规则”,其是商标权人对商标权的一种处分方式,其本质为私权利,在行为人的行为未侵犯公共利益的前提下,直接的利害关系人便是经营者,造成消费者混淆对经营者的利益有损,经营者基于对自己利益的保护,该协议能够存在便代表着混淆可能性已被消除。并且消费者的利益不完全等同于公共利益,只有涉及消费者的生命与健康权时才为公共利益,因此,不能将侵害消费者的一般混淆利益作为否定该协议效力的理由。商标共存协议的法律效力应当被肯定。我国的《商标法》中规定的先用制度为商标共存问题预留了空间,在如今商标共存协议案件频发的情况下,急需完善《商标法》,对该协议在授权确权与司法审判中的效力问题进行规制。

On the Legal Effect of the Coexistence Agreement of Trademark

Abstract:Trademark coexistence agreement is "an agreement reached by both partiesor parties that the approximate trademark can avoid the possibility of confusionand allow the parties to set rules for the peaceful coexistence of trademarks ". It is a kind of disposition of trademark right by trademark owner, which is private right.And the interests of consumers are not completely equal to the public interest,only when it involves the life and health rights of consumers is the public interest. Therefore, the general confusing interests of consumers can notbe regarded as the reason to deny the validity of the agreement. The legal effect of trademark coexistence agreement should be affirmed.The pre-use system stipulated in the Trademark Law of our country has reserved space for the problem of trademark coexistence. With the frequent cases of trademark coexistence agreement,it is urgent to perfect the Trademark Law and regulate the validity of the agreement in authorization and judicial trial.
