| 浅谈遗赠扶养协议制度的完善 【摘要】：遗赠扶养协议制度起源于我国农村五保制度，其建立的初衷是为了缓解我国人口老龄化带来的养老难问题。本文首先介绍了我国遗赠扶养协议制度，回顾其立法沿革，通过分析当下立法和司法现状，总结出我国现有遗赠扶养协议制度的立法缺陷。再结合域外继承契约相关立法与我国遗赠扶养协议作比较，最后为完善遗赠扶养协议制度提出立法建议。 【关键词】：遗赠扶养协议；遗赠扶养协议制度；继承契约；五保制度 Abstract：The bequest support agreement system originated from my country's rural five guarantees system, and its original intention was to alleviate the difficult problem of elderly care caused by the aging of the population in my country. This article first introduces our country's bequest and support agreement system,reviews its legislative development,and summarizes the legislative defects of the bequest and support agreement system through the analysis of the legislation and judicial status. Combining the legislation related to the extraterritorial inheritance contract andthe bequest and support agreement of our country to compare,finally put forward the legislative proposal to improve the bequest and support agreement system.
