MOBA类游戏的著作权保护困境与应对——以《王者荣耀》短视频侵权案为例

摘要


MOBA类游戏与具有较强故事背景和情节设定的角色扮演类RPG游戏相比,具有重交互、轻剧情的特点。而学界对游戏画面的研究往往集中在RPG网络游戏的直播画面上,与本文所聚焦的MOBA类游戏整体画面具有较大差异,不论是从技术上,还是法律研究的落脚点上都有所不同。本文以广州互联网法院审理的国内首次认定MOBA类游戏连续画面构成类电作品的《王者荣耀》短视频侵权案为例从立法者思维和裁判者思维两种角度出发进行讨论,探讨MOBA类游戏整体画面所面临的困境和解决思路。集中围绕法官在面对新的作品形式与法定作品类型都不相符时,法官是否有权选择相对合适的法定作品类型予以保护进行研究。以求更好的明晰MOBA类游戏整体画面的保护模式,解决MOBA类游戏整体画面著作权保护的困境。

The predicament and countermeasures of copyright protection of MOBA games

—— Take the "King of Glory" case as an example

ABSTRACT

Compared with role-playing RPG games with strong story backgroundand plot setting, MOBA games emphasize interaction and light plot. However, academic researches on game images tend to focus on the live broadcast images ofRPG online games, which are quite different from the overall images of MOBA games focusedin this paper, both in terms of technology and in terms of the foothold of legal research. This paper takes the case of "King of Glory" short video infringement case,which is the first time in China to recognize the continuous screen composition of MOBA games, as an example,and discusses from the perspectives of the legislator's thinking and the referee's thinking, to explore the dilemma faced by the overall screen of MOBA games and the solutions. The research focuses on whether the judge has the right to choose a relatively appropriate legal work type for protection when the new work form is not consistent with the legal work type. In order to better clarify the MOBA game overall picture protection mode,to solve the MOBA game overall picture copyright protection dilemma.
