摘 要：宋代被视为女性地位的转折点，原因可能在于宋代社会环境趋于开放，商品经济繁荣，文化蓬勃发展，价值观念日趋多样化，对女性财产继承权方面的法律有了一定的规范化。寡妇作为女性的特殊群体，其财产继承权有着独特的研究价值。本文以宋代寡妇为对象，由引言、正文和结论构成，正文主要是以财产继承制度为前提，首先探讨寡妇在宋代能够取得财产继承权的背景；其次探究寡妇财产继承权利的内容；然后分析寡妇取得财产继承权的两种途径；最后归纳出宋代寡妇的财产继承权的特点并对从中得到的影响和启示进行总结。宋代寡妇作为女性的特殊群体探讨其财产继承权为现代女性财产继承权合法权益的维护、整体地位的上升提供历史经验。

On the inheritance right of widows in Song Dynasty

Abstract: The Song Dynasty was seen as the breaking point of female position, which may be due to the opening of the social context, the prosperity of commodity economy, the vigorous development of culture, the diversification of values, and the standardization of the law of female property inheritance. As a special group of women, widows have unique research value in property inheritance. This article takes the widow of Song Dynasty as the object, consists of the index, the body and the tag, the text mainly takes the property inheritance system as the premise, Firstly, this paper discusses the setting that widows can obtain property inheritance rights in Song Dynasty; secondly, the content of widow's property inheritance rights is explored; then it analyzes the ways that the widow obtains the right of property inheritance; finally, the characteristics are summarized and the influences and inspirations are summarized. As a special group of women, the discussion on the property inheritance rights of widows in Song Dynasty is helpful to maintain the property inheritance rights of contemporary women and to provide historical and cultural experience to improve the status of women.
