摘要：刑罚执行犹豫制度作即狭义上的缓刑制度，是现代化人道主义的产物，是现代刑罚制度的重要组成部分，世界上各个国家但与其他国家相比，我国的刑罚执行犹豫制度即缓刑发展较慢，我国虽然确定了缓刑制度，但我国的缓刑制度并没有达到设立缓刑制度预期的目的，我国缓刑制度仍存在这一些缺点与不足需要完善：我国刑法对缓刑适用条件中的形式条件规定过于简单、绝对，实质条件的规定笼统、不明确，且我国缓刑制度受传统重刑主义影响，缓刑适用率低，在缓刑执行过程中，监管流于形式，监督不到位，出现脱管、漏管现象。因此，刑法应对我国缓刑适用的条件进行细化，扩大缓刑禁止使用的范围，对缓刑适用的实质条件具体化、明确化，对实质条件中的犯罪情节、悔罪表现、社会危险性等要素确立统一判断的具体标准；提倡刑罚轻缓化，转变我国传统重刑主义思想，对特殊主体可以放宽缓刑适用条件，增设罚金刑等，提高缓刑适用率；强化缓刑执行的监督考察，完善相关机构、部门的衔接，加大社会力量的参与，线上线下相结合，完善我国的缓刑执法监督机制。

Abstract： The penalty execution hesitation system is the probation system in a narrow sense,which is the product of modern humanitarianism and an important part of modern penalty system. Compared with other countries in the world,the penalty execution hesitation system in our country develops slowly. Although our country has determined the probation system,the probation system in our country has not reached the expected goal of establishing the probation system However,there are still some shortcomings and deficiencies in theprobation system in China, which need to be improved: the formal conditions in the application conditions of probation in China's criminal law are too simple and absolute, the substantive conditions are too general and unclear, and the probation system in China is affected by the traditional heavy penalty doctrine, so the probation application rate is low. In the process of probation implementation,the supervision becomes a mere formality, the supervision is not in place, and there are some problems Tube leakage. Therefore, the criminal law should refine the conditions for the application ofprobation in China, expand the scope of the prohibition of probation,specify and clarify the substantive conditions for the application of probation, and establish specific standards for the unified judgment of the elements in the substantive conditions, such as the criminal plot, penitence performance, social danger, etc.; advocate the mitigation of penalty, change China's traditional idea of severe punishment,and provide guidance for special subjects In order to improve the rate of probation application, we should relax the conditions of probation application, increase the fine penalty,strengthen the supervision and inspection of probation implementation,improve the connection of relevant institutions and departments, increase the participation of social forces, and combine online and offline to improve the supervision mechanism of probation law enforcement in China.
