摘 要

离婚经济补偿制度作为离婚救济制度之一，因适用条件严苛而运用率低，因此有学者提出取消该制度，或用其他制度取代该制度。当然，主流观点认为应当保留该制度，但应当在保留的基础上作出完善，《民法典》也肯定了这一观点。离婚经济补偿制度于2001年首次规定在《婚姻法》修正案中，后《民法典》对该制度的相关规定作出删改，现主要集中于《民法典》第1088条。笔者在本文中主要从三个部分分析该制度。第一部分主要是分析离婚经济补偿制度在司法实践中的运用情况，并引出学界对该制度的废存持有的三种不同观点；第二部分主要是借助典型案例对离婚经济补偿制度进行法理分析，找出立法和司法方面存在的不足以及问题的争议点；第三部分是提出解决方案，包括明确条文的概念，完善离婚经济补偿制度的适用条件，立法补充经济补偿的标准以及建立专门的证据规则等。

Abstract

As one of the divorce relief systems,the economic compensation system for divorce has a low application rate due to its strict application conditions. Therefore, some scholars put forward to cancel the system or replace it with other systems.Of course, the mainstream view is that the system should be retained,but it should be improved on the basis of the reservation, and the Civil Code also confirms this view. The system of economic compensation for divorce was first stipulated in the amendment to the Marriage Law in 2001. Later, relevant provisions of the system were deleted and revised in theCivil Code, which is now mainly focused on Article 1088 of the Civil Code. In this paper, the author mainly analyzes the system from three parts.The first part mainly analyzes the application of divorce economic compensation system in judicial practice and draws out three different viewpoints of the academic circles on the abolition and preservation of the system. The second part mainly analyzes the system of economic compensation for divorce with the help of typical cases to find out the shortcomings of legislation and judicature as well as the controversial points of the problem. The third part is to put forward the solution, including the definition of provisions,improve the application conditions of divorce economic compensation system,legislation to supplement the standard of economic compensation and establish special rules of evidence.
