| 论家事案件之执行
摘要
近年来，我国离婚率大幅上升，由于离婚产生的家事案件的数量同样猛增。我们从家事案件执行的性质、特点、难点等角度出发进行探讨。家事案件的执行相对于一般的民商事案件的执行而言有很大的区别，其具有显著的人身属性，因此家事案件的执行方式不能与一般的民商事案件的执行一样，在执行中经常采用强制执行措施。在家事案件执行过程中，执行人员需要关注家事案件执行过程和结果对家事案件当事人、各方家庭以及社会的影响，在此基础上选择合适的执行方式。家事案件的执行涉及大量的弱势群体，如未成年人、生活不能自理的成年人等等，执行人员应当保护未成年、生活不能自理的成年人的利益，选择更有有利于这些弱势群体的执行方式。

Abstract
In recent years, China's divorce rate has increased significantly,and the number of family cases caused by divorce has also increased sharply. We start from the nature, characteristics and difficulties of the execution of family cases.Family cases are different from the general civil and commercial cases, which have significant personal attributes. Therefore, the enforcement of family cases can not beas frequent as the general civil and commercial cases. In the process of execution of family cases,the executors need to pay attention to the impact of the execution process and results of family cases on the parties, families and society, and choose the appropriate way of execution on this basis. The execution of family cases also needs to protect the vulnerable groups involved, such as minors. The executors should protect the interests of minors and choose theexecution mode that is more conducive to the growth of minors.
