| 关于开封市丰巢超时收费法律问题调查报告
摘 要
近年来,随着我国网络在线购物的迅速兴起,网购成为了我国老百姓日常生活中不可忽视的重要组成部分,丰巢智能快递柜因此应用而生,但是随着丰巢单方面宣布“超时收费”，消费者与丰巢、快递公司之间的矛盾愈演愈烈。
其矛盾背后所产生的丰巢、消费者与快递公司之间的法律问题也值得商榷，本报告充分收集了相关的访谈资料，在明确丰巢与消费者以及快递公司之间法律关系的基础上，对丰巢智能快递柜是否可以单方面的宣布超时收费、丰巢智能快递柜所施行的超时收费是否侵犯了消费者的合法权益等相关问题进行了分析。并且基于所产生的收费标准不明确以及快递纠纷解决难等问题，提出了相关的可行性建议，一是加强快递行业的内部监管，二是完善纠纷解决机制，三是国家邮政部门应当明确统一的收费标准，四是明确快递运营者的责任，五是保障消费者的监督权和建议权。

Abstract
In recent years, with the rapid rise of online shopping in our country,online shopping has become an important part of the daily life of ourpeople, and therefore the application of the smart delivery counter hasbeen born, however, with the unilateral announcement of Fengchao "overtime charges" , consumers and Fengchao, express company between the growing conflict.
The legal issues between Fengchao,consumers and express delivery companies arising from the contradictions are also worth discussing. This report has fully collected relevant interview data,on the basis of clarifying the legal relationship between Fengchao and consumers as well as express delivery companies, this paper analyzes whether the Feng Chao intelligent express cabinet can unilaterally announce the overtime charge, and whether the overtime charge implemented by Feng Chao Intelligent Express cabinet infringes the legitimate rights and interests of consumers. And based on the problems of unclear charging standards and difficulties in resolving express disputes,some feasible suggestions are put forward,one is to strengthen the internal supervision of express industry,and the other is to improve the dispute resolution mechanism, the third is that the national postal department should make clear the unified charge standard, the fourth is to make clear the responsibility of the express delivery operator, and the fifth is to protect the consumer's right of supervision and suggestion.
