| 动机错误救济之探讨 摘要：错误类型中包括内容错误、表达错误、动机错误等，错误制度是对表意人真是意思之保护，构成错误，表意人通过撤销其意思表示来达到对自己真意之维护。对于错误中的动机错误是否可救济，一直存在争论，通过梳理比较法上的各个国家关于错误的规定，对动机错误的救济进行分析，同时结合我国的立法规定和审判实践中的案例，来对动机错误进行全面的理解。在当今交易的频繁往来，动机错误的随意可撤销会对交易带来风险，二元论的视角，可以充分平衡表意人的真意和对相对人的利益保护。 Abstract: error types include content error, expression error, motive error and so on.
