| 论人权的国际标准 摘要 人权国际标准是国际人权保护和国际人权法的基础。《世界人权宣言》宣告了人权的普遍性和“本人权宣言作为所有公民和所有国家努力实现的共同标准”，但并未就“共同标准”作更进一步解释。国际法学界中围绕人权国际标准是否存在、人权国际标准的内容和人权普遍性的依据等进行了深入的探讨，但其中许多问题和争议尚未能达成一致共识。论文使用文献分析法、比较分析法和历史分析法等方法分析了人权国际标准的形成，和国际人权宪章的执行机制；梳理了人权国际标准存在的问题和争议，最后提出了完善人权国际标准的一些建议。 关键词：国际人权法；人权的国际标准；国际人权宪章 Abstract International standards of human rights are the basis of international human rights protection and international human rights law. The Universal Declaration of human rights declares the universality of human rights and "the declaration of human rights as a common standard for all citizens and all countries", but it does not further explain the "common standard" of human rights. The international law circles have carried out in-depth discussions on the existence of international human rights standards, the content of international human rights standards and the basis for the universality of human rights, but many of them have not yet reached a consensus. By using the methods of literature analysis, comparative analysis and historical analysis, this paper analyzes the formation of international human rights standards and the implementation mechanism of international human rights charter, combs the problems and disputes existing in international human rights standards, and finally puts forward some suggestions on improving international human rights standards.
