| 数字贸易规则对国际贸易发展影响
摘 要
数字技术促使科技和产业新一轮的进步，并在全球各国引发了的新的数字经济热度。数字贸易本质是一种国际贸易，数字化时代的到来，数字贸易发展成为一种必然的趋势。数字贸易规则目前还在探索阶段，规则的建立对贸易秩序十分重要。数字贸易规则促进数字贸易发展，进而促进全球发展；个人隐私，数据流动等安全和规范规则是数字贸易进行的重要保障；而国际贸易的目的是实现各国的互惠互利发展，数字贸易规则起到了平衡各国利益的作用，只有这样才能使国际贸易顺利进行。本文主要通过结合当下的欧美数字贸易规则特征，数字贸易规则通过促进经济发展、贸易环节的便利和创新能力的提升来促进国际贸易发展，同时保障国际贸易安全和规范，使得国际贸易顺利进行，最后数字贸易规则代表着国家利益，利用数字贸易规则维护自己国家利益是每个国家的基本利益诉求，数字贸易规则制定不恰当会引发国际贸易壁垒。最终，对中国从大力发展数字贸易相关技术，积极探索数字贸易规则并对关键议题提出自己贸易主张，积极寻找合作伙伴三个方面提出相应的对策建议。本文的主要创新之处是基于相关主要的每一项电子商务条款和电信条款的具体分析，说明数字贸易规则对国际贸易影响。研究方法主要是通过对相关文献的梳理，欧美数字贸易规则对比，发达经济体与发展中经济体对比，并基于e-CO探路者项目和“棱镜门”事件进行案例研究。

ABSTRACT
Digital technology promotes the new round of progress in science and technology and industry, and has caused a new digital economic heat in all countries around the world. Digital trade is an international trade in nature.With the advent of digital era, digital trade has become an inevitable trend.The digital trade rules are still in the exploration stage,and the establishment of the rules is very important to the trade order. Digital trade rules promote the development of digital trade,and then promote global development; personal privacy,data flow and other security and normative rules are important safeguards for digital trade; and the purpose of international trade is to realize mutual benefit development of countries. The digital trade rules play a role in balancing the interests of all countries, only in this way can international trade be smoothly carried out. This paper mainly combines the characteristics of the current European and American digital trade rules, and promotes the development of international trade by promoting economic development, trade facilitation and innovation ability, and at the same time,it ensures the security and norms of international trade, and makes international trade go smoothly. Finally, the digital trade rules represent the national interests,and use the digital trade rules to safeguard our own country Family interests are the basic interests of each country. Improper establishment of digital trade rules will lead to international trade barriers.Finally, the paper puts forward corresponding countermeasures and suggestions on three aspects: developing digital trade related technologies,actively exploring digital trade rules and putting forward its own trade proposition on key issues and actively seeking partners. The main innovation of this paper is to explain the influence of digital trade rules on international trade based on the specific analysis of each of the main e-commerce clauses and telecommunication clauses. The research method is mainly through the literature review,the comparison of the European and American digital trade rules, the comparison between developed and developing economies, and based on the E-co Explorer project and the "prism gate" event.
