| 浅析工程招投标中的不正当竞争问题 摘 要 随着国家十四五规划的大力开展和中国社会主义制度的进一步发展，人们的生活水平也随之提升，对物质生活的需求也在逐日提高。对工程建筑的要求提升是提高物质生活水平不可避免的前提。而招投标制度在这之中发挥着举足轻重的地位，但在现有的工程招投标体系下，仍存在一些漏洞，让不法分子有机可趁，在招投标活动中采用不法手段，进行不正当竞争，以达到获得承接工程建设的机会。而这一行为违背了招投标活动中应当遵循的公开、公平、公正和诚实信用的原则，侵犯了国家利益、社会公众利益或者他人的合法权益。本文通过对招投标中不法行为的浅析，采用查阅文献和网络查阅的方法，对工程招投标活动中现存的不法行为提出了一些应对方法，希望能对相关部门有所帮助。 关键词：工程招投标，不正当竞争，招投标制度改进 ABSTRACT With the vigorous development of the national fourteenth five year plan and thefurther development of China's socialist system,people's living standards are also improved, and the demand for material life is also increasing day by day. To improve the requirements of engineering construction is the inevitable premise to improve the material living standards. The bidding system plays an important role in this,but in the existing project bidding system,there are still some loopholes,so that lawless elements can take advantage of the opportunity to use illegal means in bidding activities, carry out unfair competition, in order to obtain the opportunity to undertake the project construction. This behavior violates the principles of openness, fairness,impartiality and good faith that should be followed in bidding activities, and infringes the interests of the state, the public or the legitimate rights and interests of others. In this paper, through the analysis of illegal acts in bidding,using the method of literature and network access,the existing illegal acts in project bidding activities put forward some countermeasures, hoping to help the relevant departments.
