| 自媒体洗稿现状及治理探究——以“赫兹洗稿”为例 摘 要 版权意识模糊的互联网时代，随着微信公众号等各类自媒体的爆炸式发展，著作权侵权现象也呈现井喷趋势。其中，不少自媒体通过固定的内容输出形式、明确受众人群、立人设等方式洗稿给原创者及原创市场造成了严重的冲击，阻碍了文化的良性传播。自媒体洗稿的复杂性体现在侵权方与被侵权方的权力不对等，以及文字、图片、视频之间的转化难以判定。而在保护自媒体著作权上，个人、平台、政府三方都需有所作为，目前我国存在法律滞后、平台疏漏以及维权成本高等问题，导致原创者维权意愿不高或难以负担维权成本。相关法律有所革新，政法机关也大力打击，但针对逐渐产业化、规模化的洗稿现状，需要更加及时有效的举措。 本课题旨在研究自媒体洗稿的现状，对自媒体的定义与特点、自媒体洗稿的界定进行研究，然后在梳理赫兹实验室洗稿事件的过程中总结当前自媒体洗稿的方式和特点，讨论洗稿产生的影响，最后有针对性地提出相应规制措施，为自媒体作品的著作权保护提供一些建议。 关键词：自媒体，洗稿，著作权保护 AbstractII With the blurring of copyright in the Internet age,copyright infringement has also been blowout along with the explosive development of various media such as WeChat official account. Among them, we media's manuscript washing has caused a serious impact on the original creators and the original market by means of fixed content output form,clear audience group, and setting up people, which hinders the healthy spread of culture. The complexity of we media manuscript washing is reflected in the unequal power between the infringer and the infringed party,and the difficulty in judging the transformation between words, pictures and videos. In the protection of we media copyright,individuals, platforms and the government need to do something. At present, there are many problems in China, such as the lag of law,the omission of platform and the high cost of rights protection,which lead to the low willingness of the creators to protect their rights or the difficulty of bearing the cost. The relevant laws have been innovated,and the political and legal organs have also vigorously cracked down on it. However, in view of the current situation of gradual industrialization and large-scale manuscript washing, more timely and effective measures are needed. The purpose of this project is to study the status quo of we media manuscript washing,the definition and characteristics of we media,the definition of we media manuscript washing,and then in the process of combing Hertz laboratory manuscript washing event, we summarize the current mode and characteristics of we media manuscript washing, discuss the impact of manuscript washing, and finally propose corresponding regulatory measures, so as to provide some copyright protection for we media works Suggestions.
